In its judgement of 12 May 1998 – 312 O 85/98 – “Liability for links”, the State Superior Court in Hamburg decided that any person inserting a link was co-responsible, if applicable, for the contents of the linked site. This can only be prevented, continues the State Superior Court, if the person concerned explicitly distances himself from these contents.
